Barnes & Noble Inc. agreed to pay $600,000 to resolve a class action lawsuit claiming it violated the Fair Credit Reporting Act (FCRA) with unlawful employee background reports.

The case is Vicki Hebert v. Barnes & Noble Inc., Case No. 37-2019-00007178-CU-MC-CTL, in the Superior Court of the State of California for the County of San Diego.

What Is This Class Action All About?

Plaintiffs in the class action lawsuit claim the company violated the FCRA by obtaining these consumer reports for employment purposes without first making the requisite disclosures. Barnes & Noble denies the allegations but agreed to a settlement to end the claims. 

Barnes & Noble is an American bookseller with the largest number of retail outlets in the United States. As of 2022, it employed more than 19,000 people.

Class members will be paid from the net settlement fund evenly. The net settlement fund is expected to be approximately $322,626 after lawyer’s fees, expenses and the class representative payment.

This settlement benefits all individuals in the United States for whom Barnes & Noble caused a consumer report to be procured for employment purposes using a challenged disclosure form from Feb. 6, 2014, through the date of final approval on Dec. 8, 2023.
