The class action lawsuit concerns the October 2021 data security incident of Toyotetsu North America, Inc. (“Toyotetsu” or “Defendant”) in which it was determined that an unauthorized third party may have gained access to certain Toyotetsu files containing sensitive personal information for a number of individuals including names, date of birth, mailing address, or Social Security numbers (Data Incident or Data Breach). Toyotetsu denies that it did anything wrong and disputes that it has any liability but has agreed to settle the lawsuit on a class wide basis.

Eligible claimants under the Settlement Agreement will receive $250 (subject to a pro rata increase or reduction based on the amount of claims received). Claimants can receive further compensation for the actual amount of unreimbursed out-of-pocket losses up to $5,000, with supporting documentation to prove the monetary losses.
