What Is Lumondi Luminox watch fogging Class Action Settlement?

The plaintiff in the class action lawsuit says his Luminox watch developed a persistent fog only six months after he purchased it. The company repairman was allegedly unable to find anything wrong with the watch and the issue wasn’t covered by the warranty — leaving the plaintiff with a defective product.

The fogging defect allegedly occurs when the watches are worn outdoors in temperatures below 40 degrees or above 90 degrees. Lumondi is allegedly aware of this issue and included information about the fogging defect on its website.

“Regardless of whether it is ever ‘normal’ for a regular watch to fog up just because it is worn outdoors, it is certainly not ‘normal’ for a watch developed for Navy SEALs and marketed to ‘rugged outdoorsmen’ seeking ‘extreme performance’ and ‘ultimate visibility’ to do so,” the Luminox class action lawsuit contends.

The name of the case is Scott Biddick, Individually and on Behalf of All others Similarly Situated, v. Lumondi, Inc., Case No. 1:20-cv-08091, in the U.S. District Court for the Southern District of New York.

What Is This Class Action All About?

Lumondi hasn’t admitted to any wrongdoing but agreed to resolve these allegations with a class action lawsuit settlement.

Under the terms of the Luminox settlement, class members can benefit from an extended limited warranty. This warranty extends the original two year warranty on Luminox watches by 12 months. This extended Luminox warranty is limited to the fogging issues allegedly by the class action lawsuit. Damage or other issues are not included in this extended warranty.

The settlement also includes a replacement watch benefit. 

Class members who submit two qualifying claims with the extended warranty will be eligible for a free replacement Luminox watch if the warranty services don’t successfully fix the fogging issue. Replacement watches will be the same model and color as the original Luminox, if available, or a comparable design

Who Is Eligible?

The settlement benefits a nationwide class of consumers who purchased or received as a gift one or more Luminox watches with an original Lumondi Warranty Card between June 1, 2018, and Nov. 30, 2021. Watch models covered by the settlement are series 3000/3900, 3050/3950, 3120, 3150, 3160, 3180, 3190, 3250, 3500, 3510, 3580, 3590, 3600, 3610, 3800, 3810, 7050, 7060, 7200 and 7250.

How To Be Part of This Settlement

Class members whose Luminox watches aren’t covered under their original warranty have until July 27, 2023, to file a claim and receive warranty benefits. Other class members have until the end of their extended warranty period to receive benefits.

The deadline for exclusion and objection was May 30, 2022. The settlement website is LumondiWatchSettlement.us.

What Is The Pay For This Settlement?

The pay for this settlement is the warranty benefits and the proof of purchase is one photo of the watch showing fogging that was taken at least 20 minutes after the watch was returned to room temperature, and may have to send the watch for inspection by the Lumondi Authorized Repair Center technicians.
