All Class Members are members of the nationwide Class. This indirect purchaser settlement resolves only the claims against JBS. The name of the case is In re: Pork Antitrust Litigation, Case No. 0:18-cv-01776-JRT-HB, in the U.S. District Court District of Minnesota.

What Is This Class Action All About?

Pork producer JBS USA Pork has agreed to a $20 million pork prices class action settlement resolving claims it overcharged for pork; the settlement benefits indirect purchasers of pork products in the United States.

The plaintiffs’ class action lawsuit alleged the defendants and others worked together and agreed to fix, raise, maintain, and stabilize the price of pork products to drive up pork prices in the U.S., violating federal and state law; the plaintiffs claim consumers were overcharged for pork.

Indirect purchasers are those who purchase a product or service — in this case, pork — from someone other than the defendant or one of their alleged co-conspirators, such as a retailer or a wholesaler, according to Financial Recovery Strategies.

The Court has not ruled in favor of either side in this case, and both sides have agreed to the settlement.

While class members who believe they were overcharged for pork are now eligible to make claims, no money will be distributed at this point, as the class action lawsuit proceeds against the other defendants.

It is not yet known how much money each class member submitting a claim will receive. 

Payments will be based on several factors, such as the number of valid claims filed.

Any approved attorney’s fees and other costs will be deducted from the $20 million settlement fund.

Who Is Eligible?

 This settlement benefits any person or entity who indirectly purchased pork from any of the defendants or any “co-conspirator,” or their respective subsidiaries or affiliates, for personal use in the United States between Jan. 1, 2009, and April 2, 2021.

How To Be Part of This Settlement

For a class member to partake in this settlement, class members’ claim forms must be submitted no later than June 30, 2023. The deadline to opt out of or object to the settlement is Oct. 20, 2021.

What Is The Pay For This Settlement?

The pay for this settlement varies and the proof of purchase is not necessary. However, the settlement administrator may ask for additional information or documentation to support your claim.
