What Is Fashion Nova Negative Review FTC Class Action Settlement?

The FTC recently announced that eligible consumers can now file claims for a piece of a $4.2 million settlement that resolved allegations the online retailer intentionally blocked hundreds of thousands of negative product reviews. The watchdog agency finalized a settlement order with the company in March 2022, requiring Fashion Nova to not only refund certain customers but also refrain from suppressing negative reviews of its products.

What Is This Class Action All About?

In January 2022, the four-member FTC panel of commissioners filed a complaint in which they alleged Fashion Nova misrepresented that the product reviews on its website accurately reflected “the views of all purchasers who submitted reviews” about the California “fast fashion” company’s items. The FTC alleged that Fashion Nova had, in fact, suppressed reviews with ratings lower than four out of five stars.

In its complaint, the FTC accused Fashion Nova of using a third-party online product review management interface to hold back lower-starred reviews for the company’s approval while allowing four- and five-star reviews to be posted automatically. From late 2015 until November 2019, the FTC said, Fashion Nova simply did not approve or post “hundreds of thousands” of low-star, negative reviews, which the agency argued deprived consumers of possibly useful information while artificially inflating items’ average star rating.

Per the agency, the case against Fashion Nova was its first “involving a company’s efforts to conceal negative customer reviews.”

Under the settlement, Fashion Nova will pay the FTC $4.2 million to refund consumers and is prohibited from misrepresenting any customer reviews or other endorsements. The company must also post on its website “all customer reviews of products currently being sold,” with the exception of reviews that contain obscene, sexually explicit, racist or unlawful content or those that are unrelated to products, shipping or returns.

In its press release about the Fashion Nova settlement, the FTC said it is sending letters to 10 companies that offer review management services to remind them that avoiding the collection or publication of negative reviews is a violation of the Federal Trade Commission Act
