Under the terms of the settlement, class members can receive up to $500 for out-of-pocket expenses including bank fees, credit expenses and three hours of lost time at a rate of $20 per hour. 

Class members who experienced identity theft as a result of the data breach can receive higher payments of up to $3,500 for documented expenses related to their identity theft. 

All class members, even those who did not experience identity theft or out-of-pocket expenses as a result of the data breach, can receive two years of free credit monitoring services under the settlement.

The settlement benefits individuals who received a data security incident notice from Acuity on or around Feb. 15, 2022.

How To Be Part of This Settlement

For a class member to partake in this settlement, class members must submit a valid claim form by Aug. 3, 2023. The deadline for exclusion and objection is July 5, 2023.

What Is The Pay For This Settlement?

The pay for this settlement is $500 for ordinary expenses and $3,500 for identity theft-related expenses and proof of purchase is the documentation of data breach-related expenses.
